Golden Land Goutos I

1.   USE:

The lease will be used as a holiday home by the Lessee based on the provisions of article 111 of Law 4446/2016 and Law 5073/2023(A'204), regarding Short-term Leases.

The Lessee is obliged to make good use of the Lease. Any other use or conversion of the Lease is expressly prohibited.

The Lessee is prohibited from total or partial subletting and granting of use with or without consideration.

2.   POOL USAGE AND SAFETY

Guests must adhere to safety guidelines for pool use. It is strictly prohibited to leave minors unsupervised in the pool area. Failure to comply with these rules may result in termination of the agreement without a refund.

3.   LIABILITY DISCLAIMER

Accidents and Safety: GOUTOS RENTALS PORTOHELI assumes no responsibility for accidents, injuries, or incidents during your stay. Guests are responsible for the appropriate use of all villa facilities, including pools. Please note that the pool is not supervised; minors must be under adult supervision at all times.

4.   CONTRACT BREACH

Any violations of the terms of this agreement may result in immediate termination of your stay without a refund. GOUTOS RENTALS PORTOHELI reserves the right to request your departure if these terms are not adhered to.

5.   CHECK IN/ CHECK OUT

You can check-in after 15:00 on the check-in day.

You can check-out until 11:00 on the check-out day.

Early check-in and late check-out requests are subject to availability and must be pre-approved by the Sublessor. Late check-outs beyond 13:00 will be charged the full overnight rate.

6.   USE OF PROPERTY AND QUIET ENJOYMENT

Lessee agrees to use the premises in a respectful manner and comply with all local laws and Owner's rules, including but not limited to the following:

Parties, events, or gatherings exceeding the agreed guest capacity are prohibited unless prior written consent is obtained.

The pool is unguarded. All guests use the pool at their own risk. Children must be supervised at all times.

Consumption of alcohol while swimming is strictly prohibited.

Failure to adhere to these rules may result in immediate termination of the rental without refund.

Any actions causing disturbances, including but not limited to police intervention, complaints from neighbors, or violations of the property's rules and regulations, may result in the immediate termination of the rental agreement. In such cases, all payments made will be forfeited, and no refunds will be issued.

7.   OCCUPANCY

Any unregistered guests beyond the specified number are not allowed without prior written consent. Violation of this policy may result in immediate termination of the stay without refund.

8.   PETS

Pets are not allowed unless otherwise agreed.

9.   LOCKED AREAS

Vacationers may not be provided a key for Owner's personal storage spaces. Any attempt to enter locked areas is cause for immediate termination of this agreement, forfeiture of all monies paid, and Vacationers will be liable for any damage and/or missing items.

10. HOLD HARMLESS

Property is maintained in good working condition. However, neither the Owner nor the company shall be held liable for unforeseen circumstances beyond their control, including but not limited to power outages, adverse weather conditions, mechanical failures, or mandatory evacuations. In such cases, no refunds will be issued.

In the event that a significant deficiency or malfunction occurs within the villa during the rental period, through no fault of the tenant or their guests, and such deficiency materially impacts the usability of specific area(s) of the property, the tenant shall be entitled to a partial refund. The refund amount shall be proportionate to the extent of the affected area(s) in relation to the overall use of the villa. The calculation and issuance of any refund shall be determined in good faith, considering the severity and duration of the deficiency.

Furthermore, Goutos Rentals Portoheli accept no responsibility for any injury, loss, or damage to the guests or their personal belongings during their stay. Guests acknowledge and accept all risks associated with the occupancy and use of the property.

11. FORCE MAJEURE:

Neither party shall be held liable for failure to fulfill obligations due to events beyond their reasonable control, such as natural disasters, acts of government, pandemics, or other emergencies.

12. HEALTH AND SAFETY GUIDELINES:

The Lessee is responsible for using the pool and property facilities safely and ensuring children are supervised at all times.

The Sublessor provides information regarding local health and safety guidelines but assumes no liability for non-compliance.

13. TERMINATION OF STAY:

The Sublessor reserves the right to terminate the stay without refund if the Lessor violates any terms of this agreement or engages in unlawful activities.

14. GOVERNING LAW.

This Agreement shall be construed in accordance with the Laws of Greece. Every dispute shall be settled by the Courts of Athens, Greece.
